Policy 5214
EMPLOYMENT STATUS
I. PURPOSE
The purpose of the policy is to identify the different categories of covered
and non-covered,
non-faculty employees; and their corresponding terms and
conditions of employment.
II. APPLICABILITY
A. Covered Employees: The
following categories of employees are covered by the
Virginia
Personnel Act, Chapter 10, Title 2.1 of the Code of Virginia, once they
have
completed the probationary period. These employees may be full-time or
part-time.
1. Classified
Employees: These are employees whose positions are within the
occupational classes in the Commonwealth's Compensation Plan.
2. Restricted
Employees: These are employees whose positions receive at least
ten (10) percent of required funding from non-continuous or non-recurring funding
sources, such as grants, donations, contracts, capital outlay projects, or
higher
education auxiliary enterprise revenues.
B. Non-Covered Employees: The
following categories of employees are not covered
by the
Virginia Personnel Act.
1. Probationary
Classified and Restricted Employees: Until an employee in these
categories has successfully completed a twelve- (12) month probationary period,
the
employee is not covered.
2. Wage
Employees: These are employees who are used strictly to supplement
the institution's regular workforce during seasonal or temporary peaks in workloads,
or to provide interim replacement, or to perform short-term projects or other jobs
consistent with this definition. These employees are non-exempt for
purposes of
overtime compensation.

Professional, and Teaching Faculty
III. POLICY
A. Tenure of Employment:
1. Covered Employees: Employees covered by the
Act have no guarantee of
employment for any particular term,
and may be terminated in accordance
with the provisions of Department
of Human Resource Management (DHRM)
Policy 1.70, entitled
Termination/Separation from State Service, dated 09-16-93.
a. Classified Employees: Employees who occupy positions within the
occupational classes that are listed in the Commonwealths Compensation Plan,
and who are covered by the Virginia Personnel Act, as found in Chapter 10,
Title 2.1 of the Code of Virginia, once they have completed the probationary
period.
b. Restricted Employees: Employees who positions receive ten (10) percent or
more of required funding from non-continuous or non-recurring funding
sources, such as grants, donations, contracts, capital outlay projects, or
higher
education auxiliary enterprise revenues.
c. "776" Employees: These are classified employees who report
directly
to the President. These employees have certain restrictions on their rights to
continued employment. See the Chief Human Resources Officer for more
specific details.
2. Non-Covered
Employees: Wage employees have no guarantee of employment
for a particular term, serve at the pleasure of the appointing authority, and
may be
terminated from employment at any time.
B. Compensation: Compensation
for all covered and non-covered employees
identified in this policy is determined by DHRM Policy 3.05, Compensation, revised
03-01-01. Compensation must be within
one of the appropriate pay bands to which
the employee's position is
assigned.
1. Wage
Employees: Wage employees are limited to working one thousand five
hundred (1,500) hours per
agency per year. "Year" is defined as the three
hundred sixty-five (365) day period following a
wage
employee's first day of
employment. Exceptions may be granted under certain, compelling circumstances.
C. Benefits: Covered employees
and probationary employees who are eligible to
become
covered when they successfully complete the probationary period, are
entitled to accumulate and use paid leave and take unpaid leave in accordance
with
the
provisions of DHRM Policy 4.05 through 4.60, the
group of policies entitled
Benefits Management.
1. Wage
Employees: Benefits as described above are not available to Wage
employees, but employees in this category are entitled to Worker's
Compensation
coverage; leave without pay for family and medical reasons in accordance with
DHRM Policy 4.20 entitled Family and Medical Leave, revised 06-16-97; and
leave without pay for
military service with reserve components.
